By accessing and using NookFile (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your access to and use of NookFile, operated by Andaman OÜ ("we," "us," or "our").

2.1 Service Overview

NookFile is a secure file transfer service that allows users to upload, encrypt, and share files up to 6GB in size. The service uses zero-knowledge encryption technology, meaning we cannot access the contents of your files.

2.2 Key Features

• Upload files up to 6GB total per transfer
• Client-side AES-256-GCM encryption
• Files available for 1-7 days based on user selection
• Optional password protection
• No registration required
• Free of charge

2.3 Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or unforeseen technical issues.

3.1 Content Responsibility

You are solely responsible for:

• The content of files you upload
• Ensuring you have the right to upload and share the files
• Compliance with all applicable laws and regulations
• Respecting intellectual property rights
• Not uploading malicious or harmful content

3.2 Backup and Recovery

You are responsible for maintaining backups of your files. Once files expire and are deleted from our service, they cannot be recovered. We are not responsible for any data loss.

3.3 Security of Share Links

You are responsible for securely sharing the download links. Anyone with access to the complete share URL can download and decrypt your files.

You may not use NookFile to:

• Illegal Content: Upload, store, or share content that violates any applicable law
• Malicious Software: Distribute viruses, malware, or other harmful code
• Copyright Infringement: Share content that infringes on intellectual property rights
• Abuse: Use the service to harass, threaten, or harm others
• Spam: Send unsolicited bulk communications
• System Interference: Attempt to disrupt or compromise our systems
• Adult Content: Upload explicit or adult content involving minors
• Impersonation: Impersonate others or misrepresent your identity

5.1 File Size and Duration

• Maximum file size: 6GB per transfer
• Maximum storage duration: 7 days
• Files are automatically deleted after expiry

5.2 Usage Limits

We may implement reasonable usage limits to prevent abuse and ensure fair access for all users. These limits may include rate limiting and temporary restrictions for excessive usage.

5.3 Content Moderation

While we cannot access the contents of your encrypted files, we may take action based on reported abuse, metadata analysis, or other indicators of policy violations.

6.1 Zero-Knowledge Architecture

Our service is designed so that we cannot access your file contents. Files are encrypted in your browser before upload, and encryption keys never leave your device.

6.3 Security Measures

We implement industry-standard security measures to protect our infrastructure, but you are responsible for maintaining the security of your share links and passwords.

7.1 Service "As Is"

The service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure.

7.2 Limitation of Liability

To the maximum extent permitted by law, Andaman OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption.

7.3 Third-Party Content

We are not responsible for content uploaded by users or any damages resulting from downloading or using files shared through our service.

You agree to indemnify and hold harmless Andaman OÜ, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you upload or share through the service

9.1 Termination by You

You may stop using the service at any time. Since no account is required, simply discontinuing use constitutes termination.

9.2 Termination by Us

We may terminate or suspend access to the service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

9.3 Effect of Termination

Upon termination, your right to use the service will cease immediately. Any files you have uploaded may be deleted immediately upon termination for cause.

These Terms shall be interpreted and governed by the laws of Estonia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved in the courts of Estonia.

As Andaman OÜ is incorporated in Estonia, Estonian law applies to this agreement and any disputes will be subject to the jurisdiction of Estonian courts.

11.1 Copyright Policy

We respect intellectual property rights and expect users to do the same. Do not upload or share content that infringes on copyright or other intellectual property rights.

11.2 DMCA and Copyright Claims

If you believe that content shared through our service infringes your copyright, you may submit a takedown request to business#andaman.eu. However, due to our zero-knowledge architecture, we cannot verify the contents of encrypted files.

Please include in your notice: (1) identification of the copyrighted work, (2) identification of the infringing material and its location, (3) your contact information, (4) a statement of good faith belief that the use is not authorized, and (5) a statement of accuracy under penalty of perjury.

11.3 Counter-Notification

If you believe your content was wrongly removed due to a copyright claim, you may submit a counter-notification in accordance with the DMCA.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page with an updated "Last updated" date. Your continued use of the service after any changes constitutes acceptance of the new Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Andaman OÜ regarding the use of the service, superseding any prior agreements between you and Andaman OÜ relating to your use of the service.
